From the very beginning, determining the strength of the prosecution’s case and the claims made against you are key to deciding the plea you wish to take. Having the ability to liaise with the Procurator Fiscal – the name given to the public prosecutor in Scotland – we’ll grasp a view of the type of evidence obtained by the opposing party. If their case looks weak, and we can identify clear holes in their arguments, we’d look at ways we can get the charges dropped. Should the case against you be considered strong, backed by persuasive evidence and other supporting information, we may look towards an early guilty plea, should this be the stance you want to take. This is often recommended if the benefits to the defendant are significant, such as the chance of a reduced sentence.
